AMENDMENT 526

Amendment: Chapter Three, Part A, is amended by inserting an additional section as §3A1.4 (International Terrorism).

Section 5K2.15 (Terrorism) is deleted in its entirety as follows:

"§5K2.15. Terrorism (Policy Statement)

If the defendant committed the offense in furtherance of a terroristic action, the court may increase the sentence above the authorized guideline range.".

Reason for Amendment: Section 120004 of the Violent Crime Control and Law Enforcement Act of 1994 directs the Commission to provide an appropriate enhancement for any felony that involves or is intended to promote international terrorism. The amendment addresses this directive by adding a Chapter Three enhancement at §3A1.4 (International Terrorism) in place of the upward departure provision at §5K2.15 (Terrorism).

Effective Date: The effective date of this amendment is November 1, 1995.
