AMENDMENT 434

Amendment: The Commentary to §1B1.2 captioned "Application Notes" is amended in Note 1 in the second sentence of the second paragraph by deleting "as part of a plea of guilty or nolo contendere" and inserting in lieu thereof "that is set forth in a written plea agreement or made between the parties on the record during a plea proceeding"; in the second sentence of the third paragraph by deleting "the plea" and inserting in lieu thereof "a plea agreement"; and in the third sentence of the third paragraph by inserting "agreement" immediately following "plea".

Reason for Amendment: This amendment clarifies the meaning of the term "stipulation" used in §1B1.2(a) and (c).

Effective Date: The effective date of this amendment is November 1, 1991.
