AMENDMENT 117

Amendment: Section 2B6.1(b) is amended by renumbering subsection (b)(2) as (b)(3) and inserting the following new subsection (b)(2):

"(2) If the defendant was in the business of receiving and selling stolen property, increase by 2 levels.".

Reason for Amendment: The purpose of this amendment is to resolve an inconsistency between this section and §2B1.2 created by the lack of an enhancement in this section for a person in the business of selling stolen property. This amendment eliminates this inconsistency by adding a 2-level increase if the defendant was in the business of selling stolen property. Two levels rather than four levels is the applicable increase to conform to §2B1.2 because the base offense level of §2B6.1 already incorporates the adjustment for more than minimal planning.

Effective Date: The effective date of this amendment is November 1, 1989.
