Fines for Organizations
(March 2022) Chapter Eight of the Guidelines Manual sets forth the guidelines and policy statements that apply when the convicted defendant is an organization, rather than an individual, and provides the criteria by which organizations convicted of federal criminal offenses will be punished. This primer focuses on the way a sentencing court calculates the appropriate fine for an organizational defendant. This determination is made pursuant to Chapter Eight, Part C of the Guidelines Manual. Although this primer identifies some of the key cases and concepts relating to organizational fines, it is not a comprehensive compilation of authority nor intended to be a substitute for independent research and analysis of primary sources.
