§8C2.10. Determining the Fine
for Other Counts
For any count or counts not covered under §8C2.1 (Applicability of Fine
Guidelines), the court should determine an appropriate fine by applying the
provisions of 18 U.S.C. §§ 3553 and 3572. The court should determine
the appropriate fine amount, if any, to be imposed in addition to any fine
determined under §8C2.8 (Determining the Fine Within the Range) and §8C2.9
(Disgorgement).
Commentary
Background: The Commission
has not promulgated guidelines governing the setting of fines for counts not
covered by §8C2.1 (Applicability of Fine Guidelines). For such counts,
the court should determine the appropriate fine based on the general statutory
provisions governing sentencing. In cases that have a count or counts not covered
by the guidelines in addition to a count or counts covered by the guidelines,
the court shall apply the fine guidelines for the count(s) covered by the guidelines,
and add any additional amount to the fine, as appropriate, for the count(s)
not covered by the guidelines.
