Data Handout on 2026 Proposed Circuit Conflicts Amendment

Data Handout: 2026 Proposed Circuit Conflicts Amendment

(February 25, 2026)  The Commission is seeking public comment on proposed amendments to the federal sentencing guidelines.

This handout is intended to inform public comment on a proposed circuit conflicts amendment that would address two circuit conflicts involving the definition of “controlled substance offense” in subsection (b) of §4B1.2. Section 2K2.1 incorporates this definition by reference, providing for a higher base offense level if the defendant committed the instant offense after sustaining a conviction for a “controlled substance offense.”
