Antitrust Offenses

(July 2023) This primer provides a general overview of the statutes, sentencing guidelines, and case law relating to criminal antitrust offenses and the application of the antitrust guideline, §2R1.1 (Bid-Rigging, Price-Fixing or Market-Allocation Agreements Among Competitors). Although the primer identifies some of the key cases and concepts related to the sentencing of antitrust offenses, it is not a comprehensive compilation of authority nor intended to be a substitute for independent research and analysis of primary sources.
