Data on Retroactive Application of the Fair Sentencing Act Amendment

This report provides a set of tables presenting data on cases in which a motion for a reduced sentence was considered under 18 U.S.C. § 3582(c)(2). These cases involve retroactive application of the amendment to the federal sentencing guidelines implementing the Fair Sentencing Act of 2010 (Amendment 750, as amended by Amendment 759). The retroactive amendment became effective on November 1, 2011. The data in this report represents those motions decided by the courts through October 31, 2014, and for which data was received, coded, and edited by the Commission by December 16, 2014.
