Seventh Circuit - Restitution

United States v. Robl, 8 F.4th 515 (7th Cir. 2021). The court did not err when it deferred ordering restitution under the Mandatory Victims Restitution Act because the restitution amount was not ascertainable 10 days prior to sentencing; the court retained authority to order restitution outside the 90-day window prescribed by the statute. Additionally, the court did not violate the defendant’s due process rights by declining to hold a restitution hearing because the defendant did not explain what evidence he would provide; his request “amounted to seeking permission to conduct the proverbial ‘fishing expedition.’”
