United States v. White, 984 F.3d 76 (D.C. Cir. 2020). Section 404(b) eligibility depends on the statute of conviction, not the defendant’s actual conduct. A court may (and, in complex cases, must) consider the § 3553(a) factors, including “the defendant’s postsentencing behavior.”
