United States Sentencing Commission to Hold Regional Public Hearing at University of Texas at Austin. 
The Commission has scheduled a public hearing for November 19-20, 2009 in Austin, Texas. 
This edition of the Guidelines Manual incorporates guideline and policy statement amendments effective November 1, 2009, and earlier.

This report provides a history of the child pornography guidelines. This report is the first step in the Commission's ongoing examination of the child pornography guidelines.


The Commission has scheduled a public hearing for October 20-21, 2009, in Denver, Colorado, in Mineral Hall at the Hyatt Regency Denver.

A set of tables presenting preliminary data on cases in which a motion for a reduced sentence was considered under 18 U.S.C. § 3582(c)(2). These cases involve retroactive application of the crack cocaine amendment to the sentencing guidelines (Amendment 706, as amended by Amendment 711) which became effective on November 1, 2007 and which was made retroactive effective March 3, 2008. The data in this report represents those motions decided by the courts through August 27, 2009 and for which data was received, coded, and edited by the Commission as of September 2, 2009. 
Section 995(a)(1) of title 28, United States Code, authorizes the United States Sentencing Commission to establish general policies and promulgate rules and regulations as necessary for the Commission to carry out the purposes of the Sentencing Reform Act of 1984. The Victims Advisory Group is a standing advisory group of the Commission. The Commission invites any individual who has knowledge, expertise, and/or experience in the area of federal crime victimization to apply no later than November 30, 2009, to be appointed to the membership of the victims Advisory Group. Pursuant to Rule 3.2 of the Rules of Practice and Procedure of the United States Sentencing Commission, a public meeting of the Commission is scheduled for Wednesday, September 16, 2009, at 11:30 a.m. The meeting will be held at the Thurgood Marshall Federal Judiciary Building, One Columbus Circle, N.E., in Suite 2-500 (South Lobby), as detailed in the agenda.

In June 2009, the Commission published a notice of possible policy priorities for the amendment cycle ending May 1, 2010. See 74 FR 29737 (June 23, 2009). After reviewing public comment received pursuant to the notice of proposed priorities, the Commission has identified its policy priorities for the upcoming amendment cycle and hereby gives notice of these policy priorities. On May 1, 2009, the Commission submitted to Congress amendments to the federal sentencing guidelines and published these amendments in the Federal Register on May 8, 2009 (74 FR 21750). The Commission has made technical and conforming amendments, set forth in this notice, to commentary provisions related to those amendments. (74 FR 46479) 
The Commission has scheduled a public hearing for September 9-10, 2009, in Chicago, in the Ceremonial Courtroom of the Everett M. Dirksen United States Courthouse.

The Commission has scheduled a public hearing for July 9-10, 2009, in New York City, in the Ceremonial Courtroom at the United States Court of International Trade. 
This document provides a Commission staff analysis of the impact of the Influencing a Minor amendment (Amendment 7) submitted to Congress on May 1, 2009, if the Commission were to add the amendment to subsection (c) of §1B1.10 (Reduction in Term of Imprisonment as a Result of Amendment Guideline Range (Policy Statement)) as an amendment that may be applied retroactively to previously sentenced defendants. 
As part of its statutory authority and responsibility to analyze sentencing issues, including operation of the federal sentencing guidelines, and in accordance with Rule 5.2 of its Rules of Practice and Procedure, the United States Sentencing Commission is seeking comment on possible priority policy issues for the amendment cycle ending May 1, 2010. Public comment should be received on or before August 24, 2009. (74 FR 29737) 
On May 1, 2009, the Commission submitted to the Congress amendments to the sentencing guidelines and official commentary, which become effective on November 1, 2009, unless Congress acts to the contrary. Such amendments and the reasons for amendment subsequently were published in the Federal Register. (74 FR 21750, May 8, 2009). One of the amendments, specifically Amendment 7 pertaining to the undue influence enhancement at subsection (b)(2)(B)(ii) of §2A3.2 (Criminal Sexual Abuse of a Minor Under the Age of Sixteen Years (Statutory Rape) or Attempt to Commit Such Acts) and at subsection (b)(2)(B) of §2G1.3 (Promoting a Commercial Sex Act or Prohibited Sexual Conduct with a Minor; Transportation of Minors to Engage in a Commercial Sex Act or Prohibited Sexual Conduct; Travel to Engage in Commercial Sex Act or Prohibited Sexual Conduct with a Minor; Sex Trafficking of Children; Use of Interstate Facilities to Transport Information about a Minor), has the effect of lowering guideline ranges. The Commission requests comment (to be received no later than August 10, 2009) regarding whether that amendment should be included in subsection (c) of §1B1.10 (Reduction in Term of Imprisonment as a Result of Amended Guideline Range (Policy Statement)) as an amendment that may be applied retroactively to previously sentenced defendants.
