Business Meeting

William W. Wilkins, Jr., convened a telephone conference at 1:00 p.m. in the office of the Staff Director in order for the Commission to ratify a previously approved amendment promulgated under emergency authority provided in Title VIII of the Violent Crime Control and Law Enforcement Act of 1994 (Pub. L. No. 103-322, 108 Stat. 1796).

Commissioner Michael S. Gelacak, Staff Director Phyllis J. Newton, Deputy Staff Director Paul K. Martin, and General Counsel John R. Steer were present at the Commission. Chairman William W. Wilkins, Jr., and Commissioners Julie E. Carnes and A. David Mazzone participated via telephone.

AMENDMENT

5C1.2 Limitation on Applicability of Statutory Minimum Sentences in Certain Cases

Incorporates into the Guidelines Manual the text of the safety valve provision, with the addition of application notes to the guidelines that define terms contained in the provision.

Chairman Wilkins moved ratification of 5C1.2, with September 23, 1994, as its effective date, to coincide with the statutory implementation date of 18 U.S.C. 3553(f) (Limitation on applicability of mandatory minimum penalties in certain cases). Passed unanimously.
